Jento Solutions Inc. values your privacy and is dedicated to safeguarding it through adherence to this policy.

This Privacy Policy details how Jento Solutions (“Jento Solutions,” “we,” “us,” or “our”) collects, uses, discloses, and manages Personal Information (as defined below) in relation to our Jento Solutions websites (the “Site”), the Jento Solutions desktop/mobile applications (collectively, the “Jento Solutions App”), and the associated content, products, services, and functionalities provided through these online services (collectively, the “Services”). This policy does not cover our privacy practices for individuals employed directly by Jento Solutions.

A user of the Services is referred to as a “User,” or collectively, the “Users.” Users can include individuals such as website visitors, professionals seeking shifts (“Professionals”), and representatives of facilities or agencies seeking talent (“Facilities”).

In certain situations, when medical facilities or healthcare agencies use our Services to submit, manage, or otherwise process protected health information, we have agreed to act as a “Business Associate” under the Health Insurance Portability and Accountability Act (HIPAA) and only process such information on behalf of and according to the instructions of the respective Facility or agency, which is the “Covered Entity.” This Privacy Policy does not apply to such processing, and we recommend contacting the Covered Entity with any questions regarding the processing of your protected health information.

 

What Is Personal Information?

In this Privacy Policy, "Personal Information" refers to any information that identifies, relates to, describes, is reasonably capable of being associated with, or could be linked, directly or indirectly, to an individual. This does not include aggregated or deidentified information that cannot reasonably be associated with or linked to an individual.

Jento Solutions Collection of Personal Information

We collect Personal Information in various ways, including automatically when you interact with our Services, directly from you, and from other sources before our first direct interaction with you.

Personal Information Collected Directly from You

We may collect the following Personal Information directly from you:

  • Contact Information: This includes your name, employer's name (if applicable), address, phone number, email address, and communication preferences.

  •  Inquiry Information: This includes information provided in custom messages sent through our Site and when you sign up to receive information or notifications from us.

  • Professional Information: This includes your name, email address, address, zip code, phone number, licensing information, Social Security Number, date of birth, gender, driver’s license number and 

  • information, background check (including criminal history) information, physical and health-related information, COVID-19 screening and vaccination information, profile information (such as shift and facility preferences), professional history, media recordings (video, audio, images), information you provide on boards or in chats, and any other information provided during your account sign-up or through our Services. Payments are processed by our third-party provider Stripe. Although you provide your financial information (such as credit and debit card numbers) directly to Stripe, we may store or view your Stripe account data, which may include your Stripe account number and the last four digits of your credit card, debit card, and/or bank account number.   • Facility Information: This includes the facility or company name, related entities' names, names and positions of facility representatives, address, email address, phone number, profile information, billing and payment information, and any other information provided during account sign-up or through the Services.

  • Survey and Testimonial Information: This includes responses to survey questions and content of any testimonials.

  • Other Personal Information: Any other Personal Information you choose to provide.
    Jento Solutions may also collect and store certain data about your use of the Services on an aggregate and/or de-identified basis.

 

Automatically Collected Personal Information

We and our third-party partners may automatically collect certain information from your device when you visit or interact with our Services, as outlined below:

  • Device Data: This includes information such as your internet protocol (IP) address, operating system, device type and version, browser type and version, browser ID, the URL entered, the referring page or campaign, date and time of visit, other user agent string data, time spent on our Services, and any errors that occur during your visit. Device Data may overlap with other categories of data mentioned below.

  • Analytics Data: This encompasses data such as the path taken to our Services, navigation through our Services, and exit points, usage and activity metrics, and engagement metrics like how many emails we send are opened and which attachments or links are interacted with.

  • Location Data of Professionals: We collect precise and coarse geographic location information once you enable permissions on your device. This data is collected leading up to the start of booked shifts, during shifts, and when you search for "Urgent Shifts" near you. We actively track your location two hours before a booked shift to predict if you will arrive on time and share this information with the respective Facility. Passive tracking may begin up to 24 hours before a shift if you open the Jento Solutions App to ensure timely active tracking. Location data also helps us verify shift completion and show nearby Urgent Shifts. You can adjust the Jento Solutions App’s access to your location information via your device’s settings, but many features will be unavailable without “Always” and “Precise Location” permissions. 

  • Advertising/Advertising Measurement Data: This includes data related to your interactions with advertisements on our Services, such as cookie IDs or other digital identifiers, and device metadata. This data helps us and our partners serve personalized ads and measure their effectiveness.

  • Cookies and Other Technologies: We and our third-party providers use cookies and other tracking technologies (like pixel tags, web beacons, clear GIFs, SDKs, location-identifying technologies) to collect and store information about Users. These technologies help track actions and collect the Personal Information described here.

  • Analytics Tools: Tools like DataDog and UXCam may record screen visits, interaction patterns, errors, and device details within the Jento Solutions Applications. This data helps us improve our applications and services. These tools process and store the information on our behalf and do not track usage outside the Jento Solutions Applications.

  • Near-Field Communication (NFC) Tag Interactions: In facilities using NFC tags, we collect data when you tap these tags with your device to start or end a shift or break. This interaction provides us with a unique identifier, allowing us to infer your device's location. This data helps verify shift completion for earnings distribution via InstantPay.
    Our third-party partners and we may combine automatically collected information with other data about you, including information you provide.

Personal Information Collected from Other Sources

We also obtain Personal Information from third parties and often combine it with information collected automatically or directly from you:

  • Your Employer/Company: When using our Services as an employee or representative, we may receive your information from your employer or other employees at your company.

  • Other Users: Interactions with other Users on the Services may result in us receiving information you share with them. For instance, direct messages or ratings and comments from other Users are examples of such interactions.

Jento Solutions' Use of Personal Information

Jento Solutions uses Personal Information for the following purposes:

  • To fulfill or meet the reason the information was provided, such as fulfilling our contractual obligations, providing our products and Services, and processing transactions.

  • To manage our organization and its day-to-day operations.

  • To determine whether you may sign up for an account to access Jento Solutions’ marketplace as a Professional or Facility. • To request individuals to complete surveys about our organization, partner organizations, Facilities, and the Services. • To facilitate promotions, contests, and sweepstakes.

  • To offer incentives to Users in the marketplace.

  • To determine whether Professionals will arrive on time for booked shifts and whether they are at the Facilities during shifts. • To suggest and display nearby available shifts.

  • For billing, payment, identification, authentication, and fraud prevention.

  • To identify and analyze how individuals use our Site and Services and to conduct research and analytics on our User base and our Services.

  • To improve and customize our products and Services to address the needs and interests of our User base and other individuals we interact with.

  • To communicate with you, including via email, text message, social media, and/or telephone calls, and to deliver administrative notices and communications relevant to your use of our products and Services.

  • To market our Services to individuals, including through email, direct mail, phone, or text message.

  • To administer, improve, and personalize our Services, including by recognizing an individual and remembering their information when they return to our Site.

  • To facilitate User benefits and services, including customer support through our command center services. • For internal market research.

  • To test, enhance, update, and monitor the Services, or diagnose, fix, or troubleshoot technology problems.

  • To help maintain the safety, security, and integrity of our property and Services, technology assets, and business.

  • To detect, investigate, provide notice of, or protect against error, fraud, or other unlawful or criminal activity.

  • For distribution to third-party contractors that provide services to Jento Solutions and its partners.

  • To comply with legal obligations.
    When an individual chooses to contact us, we may need additional information to fulfill the request or respond to inquiries. We may provide additional privacy disclosures if the scope of the inquiry/request and/or the Personal Information required fall outside the scope of this Privacy Policy. In such cases, the additional privacy disclosures will govern how we may process the information provided at that time.

 

Jento Solutions’ Disclosure of Personal Information

We disclose Personal Information in the following ways:

  • Affiliates: We may share Personal Information with companies owned or controlled by Jento Solutions, including subsidiaries and our ultimate holding company. This sharing also includes other companies under common ownership as Jento Solutions, particularly when we collaborate to provide the Services.

  • Facilities with which You Book a Shift: We may share your geographic location with Facilities as described under “Location Data of Professionals.” Additionally, your name, licensure, qualifications, contact information, and background check results will be provided to Facilities where you have booked a shift. In some cases, we may also share other Personal Information, such as your social security number, with Facilities where you have booked a shift. This sharing is limited to instances where the information is relevant to a reporting requirement or other legal obligation of the Facilities, such as staffing reports, regulatory audits, and investigations or reports regarding allegations of Professional misconduct. 

  • Facilities in General: We may share the following Personal Information with Facilities, even if you have not booked a shift with them: your name, profile photo, any worker video clips you have provided, your total number of completed shifts, your attendance rate (calculated based on your booked and canceled shifts), and the average rating you have received from Facilities.

  • Survey, Contest, and Sweepstakes Providers, Sponsors, and Partners: We may share Personal Information with third parties who assist us in delivering survey offerings and processing responses. We may also share information with our contest, sweepstakes, and promotional providers and partners. Some Jento Solutions content is “sponsored by” or “presented by” other companies. We share market research data (e.g., sponsorship performance, contest winner names) collected on this Site, the Services, or via email surveys with these partners, usually in aggregate form. Partners may sponsor promotions, contests, and sweepstakes that require you to provide details such as your name, address, or phone number. Always check their privacy policy before sharing information. If you prefer not to share your Personal Information with these sponsors, you can choose not to participate.

  • Your Employer / Company: When you interact with our Services as an employee or representative of your company, we share your information with your employer or other employees at your company.

  • Other Users: We may share your Personal Information with other Users. For example, if you are a Professional who books a shift at a Facility, we may share your information with that Facility. 

  •  Marketing Providers: We collaborate with and share Personal Information with our marketing providers to engage with individuals regarding the Services we offer.

  • Customer Service and Communication Providers: We share Personal Information with third parties who assist us in delivering customer services and managing communications with individuals who submit inquiries.

  • Other Service Providers: In addition to the aforementioned third parties, we engage other service providers to perform various business or operational tasks on our behalf, such as payment processing, website hosting, infrastructure management, IT services, analytics, and administrative support.

  • Business Transaction or Reorganization: We may participate in corporate transactions like mergers, acquisitions, joint ventures, financings, or asset sales. During negotiations or as part of such transactions, we may disclose Personal Information to third parties. Personal Information may also be disclosed in the event of insolvency, bankruptcy, or receivership. 

  • Legal Obligations and Rights: We may disclose Personal Information to third parties, such as legal advisors and law enforcement, under various circumstances, including:

    • when required by law or if we have a reasonable belief that someone is causing harm to Users, the public, or Jento Solutions;

    • to comply with judicial proceedings, court orders, legal processes, or regulatory requests;

    • in connection with legal claims;

    • to protect our rights and property and those of others, including enforcing our agreements and policies;

    • to detect, prevent, or address fraud;

    • to safeguard health and safety; or

    • as otherwise mandated by law.

  • Otherwise With Consent or Direction: We may disclose Personal Information about an individual to certain third parties or publicly with their consent or direction. For instance, with an individual’s consent or direction, we may feature their testimonial on our Site or in service-related publications.

Except as required by applicable law, we will not disclose Personal Information regarding medical or health conditions, racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership to non-partner third parties without consent.

 

Third-Party Data Collection and Online Advertising

General: We engage in interest-based advertising and utilize third-party advertising companies to deliver targeted advertisements to you based on your personal information and to assess the effectiveness of those ads. We allow various third-party entities, including online advertising networks, measurement/attribution firms, ad fraud detection companies, social media platforms, and other services, to gather data about your usage of our online services. This enables them to display ads on our Services, other websites or platforms you visit, and across multiple devices you use.

Typically, but not always, information used for interest-based advertising is collected through tracking technologies such as cookies, web beacons, embedded scripts, and location-based technologies. These technologies recognize your device and gather data such as clickstream information, browser type, visit timestamps, mobile ad IDs, precise or approximate geolocation, and other relevant information. We may share a common account identifier, such as a hashed email address or user ID, with our third-party advertising partners to facilitate cross-device identification. We and our third-party partners utilize this information to tailor the online ads you encounter to your interests and to provide services related to advertising, such as analytics, reporting, market research, and attribution. Additionally, we may employ services offered by third parties, such as social media platforms, to deliver targeted ads to you and others on those platforms. This may involve providing your email address (usually in hashed format) or other relevant information (such as hashed phone numbers) to the platform provider through methods like API integration, direct file uploads, server-to-server transfers, or by incorporating the tracking technologies of those platforms (e.g., pixels).

Social Media Platforms and Advertising. 

Our services may feature social media elements such as the Facebook “Like” button, Pinterest, Instagram, Twitter, and similar widgets. These social media companies may recognize you, collect data about your visit to our services, and use cookies or other tracking technologies. Your interactions with these features are governed by the privacy policies of the respective social media companies.

We show targeted advertisements on platforms like Facebook, Twitter, Instagram, LinkedIn, and others. These platforms have interest-based advertising programs that allow us to display ads to users who have shown interest in our services, or to audiences with similar characteristics, such as commercial interests and demographics. As previously mentioned, we may share unique identifiers, such as user IDs or hashed email addresses or phone numbers, with these platforms, or they may collect information from our website via pixels or other methods (such as API, direct file upload, or server-to-server integration) to deliver targeted ads to you or custom audiences. These advertisements are governed by the privacy policies of the respective social media companies. If you prefer not to receive targeted ads, you can adjust your advertising preferences in your settings on these social media networks. 

Control Over Your Information

You have control over your information in the following ways:

Choice/Opt-Out of Communications

General: You can opt-out of receiving communications from us and our partners, remove your information from our database, and choose not to receive future communications unrelated to our services.

During the account sign-up process, you will be automatically subscribed to receive correspondence from Jento Solutions Inc or its partners. However, you will have the option to opt-out of receiving such correspondence. This information will remain on your profile. You may contact Jento Solutions Inc customer support at support@jentosolutions.com or 833-785-3686 at any time to update your contact information and notification preferences. If you enroll with Jento Solutions Inc, we may occasionally contact you with information about special events, activities, promotions, contests, submission opportunities, and programs. You always have the option to request that Jento Solutions Inc not contact you with this information again. 

Email Communications Preferences. If you no longer wish to receive marketing or promotional emails from us, you can click the “unsubscribe” link in the latest email you receive from us.

Telephone Calls and SMS Text Messaging We may use the personal information we collect to communicate with you via text message and telephone calls, including (with your consent) marketing messages or updates on products or services we think you may be interested in. You can unsubscribe from marketing calls or text messages at any time by replying STOP or clicking the unsubscribe link (where available) in one of our messages.

Edit Your Information You can update your personal information using the Jento Solutions app. To protect the integrity of sensitive data, certain pieces of information, such as your age, cannot be altered directly. For assistance with changing information you cannot access through your account, or if you have any other questions, please contact us at support@jentosolutions.com. Our databases automatically update any personal information you edit in your profile or request us to edit. Information transmitted through boards, chats, polls, or other means remains in our databases and becomes the property of Jento Solutions upon submission.

 

Access to Your Device Information

You can control the Services' access to your device information through the “Settings” app on your device. For example, you can revoke permissions for the Services to access your network devices, geolocation, and to integrate with other applications. Withdrawing access to certain device information may impact the features and functionality of the Services and could limit our ability to provide you with the requested Services. For instance, if you do not grant the Jento Solutions App “Always” and “Precise Location” permissions for your device’s location data, you will lose access to key features such as accessing the marketplace, booking shifts, receiving payments through Instant Pay, and seeing nearby Urgent Shifts.

Deleting Your Account or Information If you are a Professional and wish to delete your account or remove your record from our system, you can submit your request by logging into your account on the mobile app, navigating to “My Account,” selecting “Profile,” and following the instructions to “Delete My Account” at the bottom of the page. We may ask you to verify your identity before processing your request. In certain cases, we may not be able to fulfill your request if we cannot verify your identity or authority to make the request. 

When you close your account, your deactivated status will be promptly reflected in our user databases, and you may no longer be able to access your information. Please note that we may retain certain information as required or permitted by law.

Cookies and Tracking Technologies If you prefer not to accept cookies, most browsers allow you to adjust settings to: (i) notify you when you receive a cookie, allowing you to choose whether to accept it; (ii) disable existing cookies; or (iii) set your browser to automatically reject cookies. Be aware that disabling cookies may negatively impact the functionality of this and many other websites you visit, potentially disabling certain features and functionalities of the Services.

Depending on your device and operating system, you may not be able to delete or block all cookies. Additionally, if you want to reject cookies across all your browsers and devices, you will need to do so on each browser on each device you use. You can also set your email options to prevent the automatic downloading of images that may contain technologies allowing us to know whether you have accessed our email and performed certain actions with it. 

Sharing with Other Healthcare Professionals

If you are a Professional and prefer not to share your personal information and shift booking activity with other Professionals, including via our Work with Friends feature, you can disable this sharing by opening the Jento Solutions App. Tap "My Account" in the bottom right corner, then tap "Profile," and turn on "Hide me as a colleague on shifts."

Children’s Personal Information Our Services are not directed towards children under the age of 13, and we do not intentionally collect or solicit personal information from them. If you are under 13, please do not use our Services or provide any personal information to us. If a child under 13 has provided us with personal information, we encourage their parent or guardian to contact us to request its removal. Upon learning that we have collected personal information from a child under 13, we will promptly delete it.

Links to Third-Party Websites or Services Our Site and Services may include links to third-party websites, plug-ins, and applications. This Privacy Policy does not apply to, and we are not responsible for, the personal information practices of third-party websites and online services, except where we post, link to, or expressly adopt or refer to this Privacy Policy. To learn about the personal information practices of third parties, please refer to their respective privacy policies. 

Updates to this Privacy Policy We may periodically review and update this Privacy Policy at Jento Solutions’ discretion, especially as our Service expands or changes. While we will endeavor to notify you of these changes by email, we are not liable for any failure to do so. Your continued use of our Service after an update to this Privacy Policy constitutes your consent to the updated terms to the extent permitted by law. Users From Outside the United States Jento Solutions and its Services are based in the United States. Please be aware that your information may be processed and transferred to the U.S. and be subject to U.S. law. The privacy and data protection laws in the U.S. may not be equivalent to those in your country of residence. By using the Site, participating in any of the Services, or providing Jento Solutions with your information, you consent to your personal information being transferred to, stored in, and processed in the U.S.
